Tallahassee, FL (February 27, 2009) – Homes & Land Affiliates, LLC successfully enforced its trademark rights to “Homes & Land” in a recent infringement case against “Homes & Loans Magazine.” Homes & Land asserted the use of the name “Homes & Loans” was confusingly similar to its registered trademarks. Over the last 36 years, Homes & Land has perfected real estate marketing through its high quality magazines and its website, HomesAndLand.com , offering “a total marketing solution” to real estate professionals throughout North America and Canada. Homes & Loans also published a magazine featuring home listings and mortgage lender advertisements throughout the United States.

United States District Court Judge John Antoon, II, Middle District of Florida, Orlando Division, ruled that the defendants William Keeler, Robert Klezmer and Homes & Loans Magazine, LLC infringed upon the rights of Homes & Land, placing great weight upon Homes & Land’s longstanding use of its trademark name. Homes & Land, with its corporate offices in Tallahassee, FL, has been using the trademark for over thirty-six (36) years. The Court entered an injunction against the Defendants prohibiting use of the name Homes & Loans.
